Terms of Service for Private Commissions

general terms
Prices are subject to change based on demand.
I have the right to reject any order for any reason.

payment
Accepted currency is in USD ($), paid through PayPal only.
Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.
Payment will not be accepted before the commission concept is agreed upon and a slot is filled. A request for payment will be sent to the client.

process & delivery

The timeframe to finish a commission varies 1 week - 3 months, depending on factors such as the complexity and content of the commissioned piece, the amount of other commissions currently booked, and personal issues such as health or other external factors. A timeframe will be established at the beginning of the commission process and the client will be notified of any changes to that timeframe.

Once the piece is finished, the client will receive the full-resolution image along with a web-friendly size. * Note that there is no physical product. If the client wishes to have a printed version as well as digital, a small print fulfillment and shipping fee can be added ( ~ $30, depending on size)

revisions
Depending on the amount of change the client wishes to have on the final drawing, a fee will be added - unless it is a misunderstanding on the artist's behalf.
If the client wishes to change something in the drawing that has been previously approved, a fee will be added. The amount of the extra charge depends on the change desired and is typically based on an hourly wage.
If the client's reference is unclear to start with, changes will come at an extra charge.

copyright & usage
I, Quinn LeBahn-Dronet (the artist):
Reserve the right to cancel and refund the order at any time for any reason.
Retain all copyrights over the commissioned artwork.
Will NOT profit further from the commissioned artwork unless the client breaks any of the terms.
Reserve the right to post the commissioned artwork online, in my portfolio, as well as in publications, unless agreed upon with the client beforehand.
You, (the client):
May upload the commissioned artwork on any website and social media platforms.
May NOT make profits from the commissioned piece (reselling, redistributing, make prints, etc.)
May NOT alter the commissioned artwork.
May NOT use the commissioned artwork for commercial purposes.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially.
Claiming the artwork as your own.
Altering the artwork without consent.
In some cases, the commercial rights to the image may be purchased.

cancellation & refund policy
The client is not allowed a refund once work has been started on the commission.
If for any reason the artist is unable to start the commission, the client will receive a full refund.
If an order is cancelled before work is started, the client can receive a full refund.
If the client wants a refund, do not request a PayPal chargeback. The money will be transferred back to the client personally.
If the client requests a PayPal chargeback at any point when they were not allowed to ask for a refund, the client will lose all beforementioned rights to the commissioned piece and the artist will have the full right to profit further from it in any way. The artist will decline the chargeback and supply PayPal with receipts of conversations in which the commission was discussed as evidence that the artist has completed work for the client. Furthermore, the client would be blacklisted from commissioning art again.
What do you get?
Insight and involvement in concept creating before the bulk of the work is started.
An initial watermarked sketch, and potential subsequent sketches to be approved, depending on the complexity of the piece.
Full-resolution file (approx. 4000 x 5000 px at 600 DPI) of the final piece and a smaller version for internet upload. Final file formats are usually PNG.
